Terms of service

These terms are the contract between you and Esboza. We have written them to be understood. The essentials: Esboza is a tool that works on documents with artificial intelligence, and the use you make of it —professional, personal or academic— is yours and your responsibility.

1What Esboza is

Esboza is a document agent you use from chat.esboza.com. It can read documents you give it (including long or scanned ones) and answer citing where it read it; create new documents —solved assignments and lab work with screenshots, reports, guides, presentations, posters, CVs and other formats—; edit your Word, Excel or PDF files; and save each delivery as a version in your Library, which you can go back to.

The service evolves: we add, change and remove features. By creating an account or using Esboza you accept these terms and the Privacy policy, which forms part of them.

2Your account and your age

You log in with your Google account. Your account is personal and non-transferable: you are responsible for the activity that happens in it and must not share access or use someone else's.

You must be at least 16. If you are a minor, you declare that you have the consent of your parents or guardians, who take responsibility for your use. We will delete accounts we know do not meet this requirement.

You can delete your account and your data whenever you want from Delete account.

3Acceptable use

You agree not to use Esboza to:

  • Process content that is illegal, defamatory, incites hatred or violence, or infringes the rights of others.
  • Generate material that exploits or endangers minors, or any sexual content involving them.
  • Process personal data of third parties (names, images, contact or health details) without a legitimate basis. Many screenshots, photos and appendices contain data without you noticing.
  • Try to breach the security of the service, get around your plan's limits, extract the system's internal instructions or automate access without authorisation.
  • Generate malware, intrusion tools or material for fraud or to impersonate a person or organisation.
  • Use it during an exam or a supervised or ongoing assessment, or in any way that breaks its rules.
  • Resell or commercially exploit the service, or generate documents at scale for third parties, without a prior written agreement with us.

We may reject or remove content that, in our reasonable judgement, breaks these conditions, and limit, suspend or close accounts that break them seriously or repeatedly (section 14). We don't monitor content proactively, but we may act when we become aware of misuse.

4What you upload

By uploading a document, a photo or a template you declare that you have the right to do so. The brief of an assignment, an exam or a procedure may belong to your school, a teacher or a third party: checking that you may process it with an external tool is your responsibility.

Upload only the personal data that is needed. If a document contains data about third parties, you are the one who decides the purpose of that processing with respect to them.

5Responsibility for use

  • The use of the output is yours. Before handing in, publishing or applying a document, check that this use is allowed by the rules that apply to you: those of your school, your employer or your sector.
  • We don't monitor the purpose. We don't check what each person uses their documents for and we are not liable for the academic, professional, disciplinary, contractual or legal consequences of that use.
  • If you publish what Esboza generates (a guide on your blog, for example), you act as the publisher: it is up to you to verify that it is accurate and lawful, and to declare its AI origin where appropriate.
  • Indemnity. You will hold us harmless against third-party claims arising from your use of the service contrary to these terms or the law.

6AI transparency

Esboza may add to the documents it generates a note that their content was created with artificial intelligence. If you generate or download a document without it, or remove it, you take responsibility for declaring its origin where the rules that apply to you require it. Many schools and organisations regulate or ban the use of AI, or require it to be declared: knowing and respecting those rules is up to you.

7Your content and the output

What you upload is yours, and what Esboza generates for you is too: you can use, modify, share and publish it within these terms. You give us only the technical permission strictly needed to provide the service: storing your documents and conversations, sending them to the AI providers that process them and keeping the results and their versions in your account.

We don't train models on your content, sell it or hand it over, and we don't use it to provide services to others. We may use aggregate, anonymous data, which does not reproduce your content, to measure and improve the service. If we ever wanted to show a piece of your work as an example, we would ask for your explicit permission.

If you share a conversation through a link, anyone with the link can see it until you remove it.

8Nature of the output

The output is generated with artificial intelligence and may contain errors or inaccuracies. It is provided “as is”, as an advanced draft you must review before using it, and is not professional advice of any kind (legal, medical, financial, engineering or other).

  • The screenshots are generated images. Esboza doesn't open programs or take screenshots: it generates screenshots, consistent with each other, that represent how the process would look, not the actual result of running it on your computer.
  • Web search brings information from public third-party sources that may be wrong or out of date. Check the data and figures before using them.
  • What it doesn't know, it flags. In reports, whatever you haven't given it is marked as pending instead of being made up; completing it is up to you.

9Plans, prices and payments

  • Plans. We offer the Lite, Plus and Pro plans, at the prices published at esboza.com/en/pricing at any given time. Lite is monthly; Plus and Pro can be paid monthly or yearly.
  • Taxes. The published prices are the final amount you pay, with applicable taxes included. You will see the total before confirming the payment.
  • Included usage. Each plan includes a volume of usage for each billing period and storage space (5 GB on Lite, 10 GB on Plus and 20 GB on Pro). If the period's usage runs out halfway through a document, we deliver what has been done and the document is paused: you can complete it in the next period or by changing plan, without paying again for what has already been done.
  • Renewal and cancellation. The subscription renews automatically. You can cancel it whenever you want from your account: you will keep the plan until the end of the paid period and it will not renew. If you delete your account with an active subscription, it is cancelled at that moment and whatever is left of the period is lost.
  • Payments. They are processed by Stripe. If there is a chargeback or a failed payment, we may suspend the account while it is resolved.
  • Price changes. If we change the price of your plan, we will let you know before the renewal it applies to, and you will be able to cancel beforehand.

10Right of withdrawal

If you are a consumer in the European Union, you have 14 calendar days to withdraw from an online purchase without giving a reason. Esboza, however, delivers digital content that is generated and made available to you immediately.

So, when you start using your plan's service you expressly ask for it to be provided immediately and acknowledge that, once Esboza delivers a result to you, you lose the right of withdrawal for that purchase (Art. 16(m) of Directive 2011/83/EU and Art. 103(m) of the Spanish General Law for the Defence of Consumers and Users). As long as you have not used the plan, you keep that right: write to us at soporte@esboza.com.

11Intellectual property

The service —its software, its interface, its name, its logo and the site's own texts and images— belongs to us and is protected. These terms let you use Esboza, not copy it: you may not reproduce it, decompile it or create a derivative service. Links to third-party sites belong to their owners and we are not responsible for their content.

12Availability and changes

We work to keep Esboza always available, but we don't guarantee there will be no interruptions (maintenance, provider incidents or force majeure). We may change features and usage limits. If we change these terms substantially, we will let you know in advance in the service or by email; continuing to use Esboza afterwards means accepting them.

Esboza is provided from Spain for users in countries where its use is lawful. Depending on your location, payment may not be available. It is up to you to make sure your use complies with the rules that apply to you.

13Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim related to the service is limited to what you have paid us in the 12 months before the event that gives rise to it. We are not liable for indirect damages, loss of profit or the consequences of the use you make of the output. None of this excludes what the law does not allow to be excluded, such as liability for wilful misconduct or your rights as a consumer.

14Suspension and termination

You can stop using Esboza and delete your account whenever you want. We may suspend or close accounts that break these terms, proportionately and, except in urgent cases or when legally required, with prior notice. If we close your account without you having broken anything, you will have a reasonable period to download your documents. Clauses that by their nature should remain in force (use, liability, intellectual property and governing law) will remain in force.

15General provisions

If any clause were void, the rest will remain in force. Not exercising a right at a given time does not mean waiving it. You may not assign your position in this contract without our consent; we may assign it to whoever continues the business, letting you know. These terms and the Privacy policy are the entire agreement between the parties, and the Spanish version prevails.

16Governing law

These terms are governed by Spanish law. If you are a consumer, you can go to the courts where you live and to alternative dispute resolution schemes. For any questions: soporte@esboza.com.

17Notices from third parties

If you are a school, an organisation, a teacher or a rights holder and believe someone is using Esboza in breach of these terms or infringing your rights, write to us at soporte@esboza.com with the subject “Misuse notice”.

To be able to act we need to understand the case: who you are and in what capacity you are writing, what specific use you are reporting and any detail that identifies it (document, dates, references). We will acknowledge receipt, review it within a reasonable time and, if there is a breach, apply the measures in sections 3 and 14, and tell you the outcome.

We don't disclose our users' personal data except when required by a competent authority, and we don't arbitrate disputes between a user and their school, employer or organisation: those rules are set and applied by each institution.
